General Terms and Conditions (GTC) with Customer Information
1. Scope of Application
1.1 These General Terms and Conditions (hereinafter "GTC") of myvial GbR (hereinafter "Seller") apply to all contracts for the purchase and delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller via its online shop.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
1.3. Entrepreneur in the sense of these terms and conditions is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity.
1.4 Deviating or conflicting conditions of the customer do not apply unless the seller has expressly agreed in writing.
2. Conclusion of Contract
2.1 The product descriptions contained in the seller's online shop do not constitute a binding offer but serve to submit a binding offer by the customer.
2.2 The customer can submit an offer via the order form of the online shop.After completing the ordering process, the customer submits a legally binding offer for the goods contained in the shopping cart by clicking the final order button.
2.3 The seller can accept the customer's offer within two working days by:
• by sending an order confirmation via email,
• by delivering the ordered goods,
• or by requesting payment after the order has been received.
2.4 The contract text will be stored but is not retrievable for the customer afterwards. It is recommended to secure the contract data yourself.
3.Right of Withdrawal
Withdrawal Information
Right of Withdrawal:
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you or a person designated by you, who is not the carrier, has taken possession of the goods.

Consequences of Withdrawal
If you withdraw from the contract, we will refund all payments, including delivery costs (except for additional costs for a delivery method not offered by us), without delay and no later than 14 days from the receipt of the withdrawal declaration.
The refund will be made using the same payment method that you used for the original transaction.
We may refuse the refund until we have received the goods back or you have provided proof that you have returned the goods early.
Return of the goods
• The goods must be returned to us within 14 days after cancellation.
• The deadline is met if you send the goods before the 14 days expire.
Return Shipping Costs
If you exercise your statutory right of withdrawal, we will cover the return shipping costs for orders over 40 €.
For orders under 40 €, you will bear the direct return shipping costs yourself.
Please request a free return label from us before returning your item.
If the return is due to an error on our part (e.g., incorrect or damaged goods), we will cover the return shipping costs regardless of the order value.

3.1 Voluntary 365-Day Money-Back Guarantee
Regardless of your statutory right of withdrawal, we voluntarily offer you a 365-day money-back guarantee. Within 365 days of receiving the goods, you can return the order without providing any reasons.
The exercise of the voluntary guarantee is voluntary and does not constitute a legal obligation. Your statutory rights, particularly the statutory right of withdrawal and statutory warranty rights, remain unaffected.
This guarantee applies exclusively to end consumers.
The return shipping costs for using the voluntary warranty are covered by us for orders over €40. Below this amount, you will bear the costs yourself.

4. Prices &and Payment Terms
4.1 All prices are total prices including statutory value-added tax. Shipping costs are stated separately.
4.2 The following payment methods are available:

• Instant Transfer
• Prepayment
5. Delivery and Shipping Conditions
5.1 Delivery is made via DHL to the delivery address specified in the ordering process.
5.2 If delivery to the customer fails for reasons for which the customer is responsible (e.g., incorrect address, non-collection), the customer bears the additional costs for a redelivery.

6. Contract duration &and termination for subscriptions
6.1 Subscription contracts can be terminated with a notice period of 14 days to the end of the respective billing period.
6.2 The termination can be in writing or by email.
7. Retention of title
Until full payment is received, the goods remain the property of the seller.
8. Liability for defects (Warranty)
8.1 The statutory liability for defects according to §§ 434 ff. BGB applies.
8.2 customers should immediately report obvious transport damages.
9. Applicable Law
9.1 German law applies, excluding the UN Sales Convention.
9.2 This choice of law applies only to consumers, as long as there are no mandatory legal provisions of the state of residence to the contrary.
